San Diego-based Axos Bank to Acquire 25,000 Accounts, $225 million in Deposits from MWA Bank

Axos Bank, the banking subsidiary of Axos Financial, Inc., announced that it has signed a deposit assumption agreement to acquire approximately $225 million of deposits, including approximately $194 million of checking, savings and money market accounts and $31 million of time deposits, from MWABank. Axos is not assuming any assets, employees or branches in this transaction. Pending receipt of required regulatory approvals, Axos and MWABank expect to complete the deposit acquisition and transfer by March 31, 2019.

Apple to Build New Campus in Austin, Add Sites in Seattle, San Diego and Culver City

Apple today announced a major expansion of its operations in Austin, including an investment of $1 billion to build a new campus in North Austin. The company also announced plans to establish new sites in Seattle, San Diego and Culver City and expand in cities across the United States including Pittsburgh, New York and Boulder, Colorado over the next three years, with the potential for additional expansion elsewhere in the US over time.

Another Section of Cliff Collapses in Del Mar

Another section of cliff between the train tracks and the Pacific Ocean has collapsed into the sea.  It slowed down train service throughout the morning (we noticed that as the trains passed much more slowly through Del Mar) and took out a portion of a trail used by surfers to get to the beach.

This is at least the 4th partial collapse in recent months.  One has to wonder how much longer the Amtrack and Coaster trains will be able to operate safely on the same tracks …

US Representative Darrell Issa’s Statement on Justice Kavanaugh

WASHINGTON, D.C. — Congressman Darrell Issa (R-Calif.), a senior member of the House Judiciary Committee and Chairman of the Subcommittee on Courts, Intellectual Property and the Internet, released the following statement on the confirmation of Brett Kavanaugh to the United States Supreme Court.

“The swearing in this evening of Justice Brett Kavanaugh brings a just and honorable end to a terribly distressing confirmation process that repeatedly threatened to upend the most vital standards of fundamental fairness. That it did not succeed will restore at least some confidence that the system can work as intended, and that the American experiment has once again proved as durable as ever.

“What should never be forgotten, however, is the damage that has been done. This was supposed to be a fair and reasoned review of a nominee’s record on the bench, understanding of the Constitution, and vision of the role of the federal judiciary. It was instead a carefully coordinated political attack that was plotted in secret, coordinated among Senators and staff, and intended to destroy a good man. This did, indeed, replace the doctrine of advice and consent with a mission to search and destroy.

“It is my full expectation that as an Associate Justice, Brett Kavanaugh will display the same careful consideration for the facts, adherence to the law as written, and impartial and independent judicial temperament that has marked his entire judicial career. I further trust that he will be able to look past the terrible way he and his family were treated by powerful interests in Washington, keep faith that he persevered through it all, and serve with honor and distinction for many years to come.

City of Del Mar Contractors Using Deadly Chemicals in Public Spaces

Fusilade Used by City of Del Mar ContractorsThe following is an email I sent to Del Mar City Manager Scott Huth on September 7, 2018:

Hi Scott – I hope all is well.

This morning on her 2nd birthday, I was walking my daughter down to the tot lot by the beach.

We stopped to check our mail at the post office and then continued down 15th toward Coast Blvd.  I started smelling noxious chemicals – and then noticed one of the landscapers working on the corner (I assume it is City property) was spraying weed killer.  Before we were overcome with it, I turned around went back up the block and crossed the street.

I have a few questions for you:

1. Were these workers there on a City contract?
2. Does the City know they are using chemical weed killers and spraying them in public without notice or regard to the environment?
3.  Is the City of Del Mar ok with this?
4.  Is anyone thinking about where those chemicals end up?  Gutters, drains, sewers, beach and ocean ….

And most importantly,

5) What can be done to ensure that my daughter is never exposed to dangerous chemicals like in Del Mar again?

This morning while walking home from a nice long beach walk between Del Mar and Torrey Pines State Beach, Ava Kalea and I came across a white bicycle chained to a pole on the side of the bike lane heading south on Camino Del Mar towards Torrey Pines.  I think I noticed this bike because it was painted all white – including the wheels, tires and chain – so we went to examine it.  On the white bike was strapped this flyer:

LA Detective Brian R Villa

When I got home I did some investigating and found this article in Biking in LA about LA County Sheriff’s Detective Brian R Villa getting into an accident while riding in a bicycle race called Orange County Wheelmen’s Amtrak Century.  It is readily apparent that Brian R Villa was a good man who was loved by many.  This really hit home for me, as he was almost a year younger than I – and probably in a lot better condition.  I would like to thank him and his family for his service to our country while in the Marines – and keep his family in my thoughts and prayers.

Qualcomm $16 Billion Share Repurchase

Qualcomm Incorporated announced on September 13, 2018, that it has entered into accelerated share repurchase agreements with each of Bank of America, N.A., Citibank, N.A. and Morgan Stanley & Co. LLC to repurchase an aggregate of $16 billion of the company’s common stock, with an initial delivery to Qualcomm of approximately 178 million shares in the aggregate.

The final number of shares to be repurchased will be based on the volume-weighted average price of Qualcomm’s common stock during the term of the transaction, less a discount and subject to adjustments pursuant to the terms and conditions of the ASR Agreements.
